I am on the board of a 52 unit building, one board member wants to make it a smoke free building including the owners private units. Could the master deed be changed to make it a smoke free building? If it is allowed how difficult would it be enforce , if the unit owner simply states that they are not smoking in there unit and it is coming from another unit , how could the board enforce such a policy without any evidence?

We cannot get a quorum for annual meeting. We are required to have an annual meeting. We did a vote with owners in attendance and voted to not attempt another annual meeting until next year. Some are saying that’s improper. What else can we do?

I am the president of a condo association. Our building does not allow short term rentals. A fellow board member asked the board if we would allow them to do a three month summer rental, we advised them that they can not. The following day they listed the unit with a realtor for a three month summer rental. After pressure from the board they removed the listing. The same board member owns a contracting company, recently a unit they were working on violated condo policy and was staging debris in the hallway. The majority of the board decided to fine the unit owner. Is there a legal perspective that these actions would warrant removal from the board?

As a board member, I sent my own attorney an agreement currently under review. I feel my own attorney is an extension of myself and therefore should be allowed to review the documents. A majority of my fellow board members say no and now say I will no longer be allowed to sit in or receive documents related to this issue. Of course my mistake was saying something, but can they do that?

The previous board did not create a reserve for roof repairs and we know we have to apply a $5000 or so assessment. Unfortunately, the assessment will destroy the community politically. We are the first board in a long time doing the right thing. As a board we are debating whether or not we underfund the project, for the long-term health of the association. How does fiduciary duty stand up against taking action the board knows will drive the community apart?

I am on the board of directors in my condo community. Some people bought electric cars, which is great. But they run their power cord across the sidewalk to their parked car. We are concerned about snow plows, residents tripping and so on. Do we have the right to make them install a charging station in their parking spot?

My wife and I are planning to buy a home in a 55 and over HOA with single family homes. I’m just 55 now, and my wife is a few years younger. We have one child who is only 25 who lives independently in another state. We’re a little concerned, should something happen to my wife and I, would our son still be able to inherit the property? In order to purchase in the community, at least one owner needs to be least 55 or older.

How do you handle in a non smoking building when a renter comes in and smokes in their unit nonstop, which causes the smoke to seep through vents and walls into their neighbor units and causes ill effects on the non smoking homeowner?
