When Owners Just Plain Say “No” and Won’t Budge
You need them to move. You’ve asked nicely, you’ve attempted to accommodate, you’ve threatened but that owner will not just move an inch.
We will discuss several scenarios with our panel. Here are just a few:
– There is a serious leak. You need access to an owner’s unit to investigate and repair. You show up at the door and they say “Nope”.
– The association needs access to an unit to make a non-emergency repair. They say “no and never”.
– The owner is disrupting the owner’s meeting. You’ve ordered them to leave and they just say “Make me”.
– An owner has had their amenities privileges suspended. They show up at the pool anyway, plop down in a chair and say “I’m staying”.
– The association is making deck repairs and has ordered some unit owners under the repair area to not utilize their decks during the process. One owner, says “No, I’m sunbathing and that’s that.”.
– The high-rise association is having work done on tendons in concrete. It is dangerous work and owners must vacate units in the area for up to four hours. One owner says, “I’m not leaving”.

- What does the board or manager do?
- Will the police intervene?
- Can the association barge in on their own?
- Should the association wait until the owner leaves and enter anyway?
- What about when damage is happening in real time?
- What if safety is an issue?
- Liabilities of taking the wrong action or not action
- What if an owner is disabled?
- What if an owner has pets that need accommodation?
- What are steps for each scenario?
- Do associations have the right to hire and charge the owner for security to physically keep them from entering suspended areas
